1 Agreement

When you sign up for ProfutureDomains services, you agree to these Terms of Service. They form a binding agreement between you and ProfutureDomains. If you don't agree with any part of these terms, please don't use our services.

We may update these terms occasionally. If we make significant changes, we'll let you know via email. Continuing to use our services after changes means you accept the updated terms.

These terms apply to everyone who uses ProfutureDomains — whether you're browsing our website, creating an account, or running services on our platform. If you're accepting on behalf of a company or organization, you confirm you have authority to bind that entity.

2 Our Services

ProfutureDomains provides server hosting, cloud infrastructure, and related services designed to help your business grow. This includes virtual servers, managed backups, DDoS protection, and more.

Specific features, resource allocations, and pricing are detailed on our website and in your client portal. We're always improving our platform and may introduce new features or retire older ones with advance notice.

While we strive for broad compatibility, we can't guarantee that our services work with every third-party tool or software. Please verify compatibility with your requirements before committing to a plan.

3 Your Account

Keep your login credentials safe — you're responsible for all activity that happens under your account. Please provide accurate billing and contact information and keep it up to date.

If you suspect unauthorized access to your account, let us know immediately at [email protected] so we can help secure it.

We recommend enabling two-factor authentication for added security. Accounts may not be shared with or transferred to another party without our prior written consent. We reserve the right to suspend accounts that appear compromised to protect your data.

4 Fair Usage

Use our platform responsibly. We want everyone to have a great experience, so please avoid activities that could harm other users or our infrastructure. This means:

  • No hosting illegal or harmful content
  • No spamming or sending unsolicited emails
  • No unauthorized cryptocurrency mining
  • No attempting to access other users' accounts or data
  • No deliberately overloading or abusing shared resources
  • No distributing malware, phishing tools, or exploit kits
  • No port scanning or network probing of third-party systems
  • No hosting content that promotes violence, hatred, or discrimination

Serious or repeated violations may result in immediate suspension of your services. We'll always try to reach out and give you a chance to fix things first, unless the violation is severe enough to warrant immediate action.

5 Uptime Commitment

We guarantee 99.99% infrastructure availability, measured monthly. Scheduled maintenance (which we announce in advance) is excluded from uptime calculations.

If we fall short of this commitment, you're eligible for service credits. Just reach out to our support team within 30 days of the incident and we'll make it right.

Credit tiers: for uptime between 99.9% and 99.99%, you'll receive a 10% credit on monthly fees; between 99.0% and 99.9%, a 25% credit; below 99.0%, a 50% credit. The maximum credit is 50% of the monthly fee for the affected service. Credits are applied to your account and are not refundable as cash.

This commitment doesn't cover disruptions caused by events outside our control, actions you take on your services, or third-party outages beyond our infrastructure.

6 Billing & Payments

We bill on a monthly cycle, and all prices are in USD. Invoices are generated automatically and payment is due within 14 days. Your services renew automatically each billing period unless you cancel.

If a payment fails or is overdue, we'll reach out to help resolve the issue. Continued non-payment may result in service suspension. Overdue amounts accrue interest at 1.5% per month or the legal maximum, whichever is lower.

We'll give you at least 30 days' notice before any price changes take effect. Changes apply at the start of your next billing cycle. If you cancel, you'll receive a prorated refund for unused time. You're responsible for any applicable taxes or duties on your services.

7 Your Data

We handle your data with care. All data is stored in European data centers with encryption at rest and in transit. We're fully GDPR compliant and take our data protection responsibilities seriously.

Your data belongs to you. We provide tools to export your data at any time, and we never share your information with third parties for marketing purposes.

As a data processor, we only process your data per your instructions. A Data Processing Agreement (DPA) is available on request. We use AES-256 encryption at rest and TLS 1.3 in transit. We conduct regular security audits and penetration tests. If a data breach occurs, we'll notify you within 72 hours as required by GDPR.

8 Intellectual Property

Everything that makes up the ProfutureDomains platform — our software, designs, branding, documentation, and APIs — is our intellectual property (or that of our licensors) and is protected by applicable copyright, trademark, and other laws.

Your content, data, and applications remain yours. We only use them to deliver the services you've signed up for. This limited license ends when you close your account.

Please don't copy, modify, or reverse-engineer any part of our platform, and don't use our trademarks or branding without written permission.

9 Our Liability

Our total liability for any claims related to our services is limited to the fees you've paid us in the six (6) months before the issue arose.

We're not responsible for indirect damages like lost profits, lost data, or business interruption, to the extent permitted by law. We always recommend maintaining your own backups as an additional precaution.

We're also not liable for issues caused by force majeure events (natural disasters, power outages, government actions), third-party service failures, or actions you take on your own services. This limitation applies to the fullest extent permitted by the laws of the Netherlands.

10 Indemnification

You agree to indemnify and hold harmless ProfutureDomains, its team members, and affiliates from any claims, damages, or expenses (including legal fees) arising from:

  • Your use of our services or activity under your account
  • Your violation of these terms or any applicable law
  • Any infringement of third-party rights through your content or applications
  • Data you store, process, or transmit through our platform

This indemnification obligation continues even after your account is closed or these terms end.

11 Cancellation

You can cancel your services anytime from your dashboard — no hoops to jump through. When you cancel, you'll receive a prorated refund for any unused time in your current billing period.

After cancellation, we'll keep your data available for 30 days so you have time to export anything you need. After that, it will be permanently removed from our systems.

We may terminate your services immediately if you seriously breach these terms, especially our Fair Usage policy. Outstanding invoices remain due after termination. Provisions that should survive — like liability, indemnification, and intellectual property — continue in effect.

12 Dispute Resolution

If a disagreement comes up, we'd prefer to work it out together. Either party can start the conversation by sending a written notice describing the issue. We'll try to resolve things through good-faith discussion within 30 days.

If we can't agree, the next step is mediation with a mutually agreed mediator in the Netherlands. Mediation costs are shared equally. If mediation doesn't resolve things within 60 days, either party may take the matter to the competent courts in the Netherlands.

13 Changes to Terms

We may update these terms from time to time. When we do, we'll update the "Last updated" date at the top of this page. For significant changes that affect your rights, we'll give you at least 30 days' notice via email.

By continuing to use our services after updates take effect, you agree to the revised terms. If you don't agree with a change, please stop using our services before the change becomes effective. We recommend checking this page periodically.

14 Legal Jurisdiction

These terms are governed by the laws of the Netherlands. Any disputes that can't be resolved between us directly will be handled by the competent courts in the Netherlands.

If any part of these terms is found to be unenforceable, that part will be enforced as far as possible, and the rest of the terms continue to apply. Our not enforcing a specific right doesn't mean we've waived it.
